Highway Paving Worker v. General Contractor and Flagging Contractor 2016

TCNF trial team Ray Thomas, Cynthia Newton and Jim Coon obtained a confidential multiple seven-figure settlement shortly before trial  for a father of two who was run over by a paving machine in the early morning hours on a highway construction project in the Portland area.  His wife and childrens’ loss of consortium and L&I comp claim were included in the global settlement. He received multiple lower extremity fractures and a degloving injury in the job site accident including traumatic asphyxiation leading to blindness. We alleged that the failure to provide an on site traffic control plan for workers on foot and the failure to provide a lookout or spotter caused the injury.
