A Win for Injured Workers


The Oregon Supreme Court handed Oregon injured workers a much needed win with Garcia-Solis v. Farmers Ins. Co.  This case will help injured workers access critical diagnostic care. Before this case, injured workers who had an accepted workers’ compensation claim couldn’t get access to diagnostic services to figure out what medical condition their work accident caused. The insurer would only pay for medical services for medical conditions it had officially accepted to the claim. So a worker with an accepted claim for a neck strain couldn’t get any diagnostic services for anything else, even if the doctor thought the worker might have suffered additional injury from the work accident but needed diagnostic services to confirm that. This left workers in an impossible situation, unable to get the services they needed to get properly diagnosed, treated and back to work. Our partner, Jim Coon, authored the “Friend of Court” brief on behalf of the Oregon Trial Lawyers Association that helped the Supreme Court understand the issue.
